
WAIVER AND LIABILITY
In consideration of being permitted to participate in any way in any Midwest Shito Kai activity I, for myself, for the participating minor's parent and\or legal guardian, my personal representatives, assigns, heirs, and next of kin, the undersigned:
1. Acknowledge, agree, and represent that I understand the nature of the activity and that I am qualified, in good health, and in proper physical condition to participate in such activity. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the activity.
I have read this agreement in full and fully understand its terms, understand that I have given up substantial rights by purchasing this membership and have purchased this membership freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
2. Fully understand that: (a) athletic activities involve risks and dangers of serious bodily injury, including permanent disability, paralysis, and death (risks); (b) these risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the activity, the condition in which the activity takes place or the negligence of the "releases" named below; (c) there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation or that of the minor in the activity.
3. Hereby release, discharge, and covenant not to sue the Midwest Shito Kai, related affiliated and subsidiary companies, as well as the officers, directors, agents, employees and signs of each, and the World Shito-Ryu Karate-do Federation, Karate-do Shito-Kai Murayama USA, or refering karate school, clubs, coaches, officials, administrators, members, volunteers, participants, sponsors, advertisers, and if applicable, owners and lessors of premises on which an activity may take place, and any other party indemnified and held harmless by the Midwest Shito Kai (each considered one of the "Releases" herein), from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the "releases" or otherwise, including negligent rescue operations, negligent security, travel, and recreational operations and activities; and I further agree that if, despite this release and waiver of liability, assumption of risk, and indemnity agreement I, or anyone on my behalf, makes a claim against any of the releases, I will indemnify, save, and hold harmless each of the releases from any litigation expenses, attorney fees, loss, liability, damage, or cost which any may incur as the result of such claim.
4. By my purchase below I confirm that I am in sound health and there is no reason why I cannot participate in Midwest Shito Kai activies.
5. No refunds will be given. All purchases are final. I consent that any pictures, videos, audio records taken of me in connection with the Midwest Shito Kai can be used for publicity or promotion, now or in the future, and I waive compensation in regard thereto. All participation in any activity is by permission only. The Head Sensei or his authorized agent (s) reserve the right to refuse entry to any person, school, team or club.
6. All participants must exhibit behavior and manners consistent with the code of ethics and good sportsmanship. Any acts or statements which are disruptive to the operation of any Midwest Shitko activity, or which are insulting, offensive or otherwise inappropriate may result in revocation of membership and removal from an activity.
7. An inherent risk of exposure to COVID-19 exists in any public place where people are present and where you may be filing. According to the Centers for Disease Control and Prevention, participants with underlying medical conditions are especially vulnerable. By participating in a Midwest Shito Kai activity, you voluntarily assume all risks related to the exposure to COVID-19.
